DMCA / Copyright Notice

Evolviture respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"). This page describes the information that should be present in these notices and our procedures for handling such claims.

Copyright Policy

All content and digital products available on Evolviture, including but not limited to software, templates, graphics, designs, text, and other materials, are protected by copyright laws and are the property of Evolviture or its content creators and licensors. Notice of Alleged Copyright Infringement

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement and is accessible on our website, please notify our Designated Copyright Agent with the following information:

  • Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.

  • A statement of accuracy: A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  • Your signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

Counter-Notice

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with our Designated Copyright Agent. A counter-notice must include the following:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Delaware if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Evolviture has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentations

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. Please ensure that your claims are accurate before submitting a notice or counter-notice.

Our Commitment to Copyright Protection

Evolviture is committed to complying with copyright and related laws, and we require all users of our services to comply with these laws. We will investigate notices of alleged infringement and will take appropriate action under the DMCA and other applicable intellectual property laws. This may include removing or disabling access to material claimed to be the subject of infringing activity.

Reporting Other Intellectual Property Violations
