Terms of Service

Acceptance of Terms

Welcome to Evolviture! These Terms of Service ("Terms") govern your access to and use of the Evolviture website (the "Site") and the purchase or use of any digital products offered (collectively, the "Services"). By accessing the Site or purchasing a digital product, you agree to be bound by these Terms. If you do not agree, you must not use our Services. You indicate acceptance by checking any required "I Agree" box or by actually using the Site or making a purchase. We may update these Terms from time to time, and will provide notice by updating the "Last Updated" date or by other means. Continued use of the Services after changes constitute your acceptance of the revised Terms. You represent that you are at least 18 years old (or the age of legal majority in your jurisdiction) and are legally capable of entering into this agreement. If you are using our Services on behalf of an organization, you agree to these Terms for that organization.

Payments and Pricing

All prices for digital products are listed on the Site, and are subject to change at any time. You agree to pay all fees for purchases you make, including any applicable taxes or charges. Prices are typically shown in U.S. Dollars (USD) unless indicated otherwise. By submitting a payment (via credit card, PayPal, or any other payment method we support), you authorize us (and our payment processor) to charge the listed fees to your provided payment method. You must provide current, complete, and accurate billing information. If your payment method fails or is declined, we may cancel your order or suspend delivery of the product. All sales are final upon delivery of digital content – due to the intangible and irrevocable nature of digital goods, no refunds will be issued once access to the product has been granted (see our Refund Policy for more details and legal exceptions). We reserve the right to refuse or cancel any order if fraud or unauthorized or illegal transaction is suspected.

License and Intellectual Property

All content and digital products available through Evolviture (including software tools, templates, packs, graphics, and other downloadable materials) are the intellectual property of Evolviture or its licensors. When you purchase a product, you are granted a limited, non-exclusive, non-transferable license for your personal or internal business use of that product. No ownership or intellectual property rights are transferred to you – the product is licensed, not sold. Except as expressly permitted by Evolviture, you may not copy, reproduce, modify, or distribute any product to anyone else. Any use of our products beyond the scope of the purchased license (such as sharing downloads with the public or reselling content) is a violation of these Terms and the License Terms (EULA). We reserve all rights not expressly granted. Evolviture's trademarks, logos, and service marks are owned by us. You may not use our marks without our prior written consent.

User Accounts and Conduct

If the Site allows you to create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide truthful and accurate information. You must use our Services only for lawful purposes and in compliance with these Terms. You agree not to engage in any activity that interferes with or disrupts the Site (such as hacking, scraping, or using bots), and not to use the Site to transmit any malicious code or illegal content. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

Termination

Evolviture may, in its discretion, suspend or terminate your access to the Site or Services at any time if you violate these Terms or other policies, or engage in unlawful or prohibited use. We may also terminate the license to any digital product if we discover a breach of the License Terms (EULA). In such cases, you will not be entitled to any refund for purchases already made, as digital products are delivered on a final sale basis. You may terminate your account or cease using the Services at any time. Upon termination (by you or by us), you must immediately stop using any purchased products (if your license is terminated) and delete any copies in your possession or control. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, arbitration, and liability provisions) will continue in effect.

Limitation of Liability

To the fullest extent permitted by applicable law, Evolviture and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Services or purchase of products, including but not to loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages. In jurisdictions that do not allow the exclusion of incidental or consequential damages, you may not be subject to the above limitation, but in such cases our liability is limited to the greatest extent permitted by law.

Maximum Liability: Under no circumstances will our total liability to you for all claims arising from or relating to the Services or products exceed the amount you paid Evolviture for the specific product or service at issue in the 12 months preceding the claim (or USD $100 if no purchase was made). This limitation is cumulative and not per-incident.

Governing Law

These Terms and any dispute arising hereunder are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles, and as applicable, the federal laws of the United States. Notwithstanding the foregoing, we recognize that consumers in some jurisdictions (e.g., EU/UK) may have certain mandatory rights under local law. In such cases, Delaware law will apply only to the extent it does not deprive you of any consumer protections afforded under the law of your residence.
